COMPLICATIONS OF MILITARY DIVORCE
There are certain laws that will apply to your case in order to protect you during divorce. Hiring a lawyer who is aware of these laws is advantageous to your case.
For example, you are protected from having to deal with legal action for up to 60 days after you complete a tour of active duty. This may provide some relief since you do not have to worry about divorce shortly after you return home. In addition, this means you will not be unaware that your spouse has sent divorce papers while you are away on active duty.
Of course, unlike a regular divorce, your spouse first needs to find out where you are currently serving before he or she can serve the divorce papers. This may create a brief delay in the case.
You are required by the military to support your family, such as by paying child support. However, you do not typically have to split your retirement benefits with your former spouse unless you have been married for at least ten years while you were on active duty.
