CASES HANDLED BY NEW YORK FAMILY COURTS

New York City Family Courts aim to address legal matters that affect the lives of children, parents, and spouses. Types of cases handled by Family Court include: child abuse and neglect, child custody, adoption, visitation, domestic violence, guardianship, foster care, juvenile delinquency, paternity, Persons in Need of Supervision (PINS), child support, and spousal support.

WHAT TO EXPECT

In Family Court, there are no trials by jury. Most hearings are heard by judges, although support and paternity cases are heard by magistrates, or lower court judges. The judge or magistrate determines the outcome of each case, and after a decision is made, either party has the right to appeal the decision by requesting that a higher court review the case. An appeal can bring about a reversal or a modification of a Family Court decision, or can result in the decision remaining as it is.
