Handling Divorce in the State of New York
Divorce can be difficult. Unlike other legal matters, divorce is largely wrapped in emotions and can be an immense emotional and mental obstacle in individuals’ lives. In order to help make the divorce process as pain-free as possible, here are a few little-known tips to having a successful outcome, or obtaining your goals in a divorce case:
1. Communication is Key
Because every form of communication between you and your spouse can be used in court as evidence, make sure that your emails and text messages do not harm your position in court. Despite how frustrated you may be, it is important not to send any derogatory or angry emails, text messages, or voicemails to your spouse or to his/her family or friends. Alternatively, you can create a helpful record for yourself by using emails and text messages to create a record of your objectives. For example, if you want to spend more time with your children, you can prove this by showing emails you sent making this request to your spouse.
2. Follow proper etiquette during the case and in court
For instance, avoid speaking to the opposing lawyer without your lawyer’s presence and permission, don’t show any anger or attitude towards your opposition, and do not speak or react when on the record before the judge, to name a few. Although divorce is, understandably, a highly emotional time, it is important not to show emotion in the courthouse in order to prevent the opposition from using that against you. The less the opposition can observe about you, the better.
3. Be cautious about your use of modern technology
Social media web sites, such as Facebook and Twitter, can be accessed by the opposition and information from these sites can be used to pole wholes in your credibility. Review the terms of privacy on social media sites and take caution when making public posts.
